20101056 - CRIMINAL COMMERCIAL LAW (objectives) The course is aimed at examining the relationship between general principles of criminal law and complementary legislation, with particular reference to the corporate and bankruptcy issues. Particular attention will be paid to the analysis of recent legal reforms of 2002, 2005 and 2006. The course will offer a particular focus on the modern techniques of indictment, spurred also by the initiatives of the Community institutions. 20110046 - Diritto Penale Europeo (objectives) The course "European Criminal Law" aims to examine the progressive influence on the national criminal law by European law, that include the EU law and the ECHR system. Until a few decades ago the combination of "European law" and "criminal law" appeared almost an oxymoron. The system of sources of law is conversely today more complex and labyrinthine and, at least in some respects, it is gradually changing the face of criminal law, that seemed like the more solid articulation of national sovereignty. The lessons will be developed following the main theme of the principle of legality in criminal law, in its articulations of the legislature's exclusive power to create crimes, the principle of determinacy and the principle of non retroactivity of criminal law (supplemented by that of the retroactivity of more favorable law): the objective it is to examine the metafomorphosis of the criminal legality, especially as a result of European jurisprudence. The course will also try to focus on the significant changing of the Italian system of sanctions as a result of the europeanisation of criminal law, on the side of the "double track" between criminal penalties and security measures and on the side of the compresence of criminal and administrative sanctions. 20110048 - Protezione dei dati personali e tutela dei diritti fondamentali-Clinica legale privacy (objectives) The course "Protection of personal data and protection of fundamental rights - Privacy Law Clinic" (ECTS), from a Public Law perspective, allows the students to engage in practical activities, based on the theoretical lessons of the first part of the course, according to the "learning by doing" method. The idea for the course comes from the awareness that the fundamental rights are now an established heritage of our legal tradition, both at national and european level: we now appreciate a multi-level protection of fundamental rights, made possible by the constitutional clauses that allow the opening to international and European Law. In this context, the right to privacy, codified by the Privacy Code (Legislative Decree. N. 196/2003), is a fundamental human right, as a direct explication of dignity, also due to the contribution of Eu Law and ECHR. Therefore, the right to privacy, both in the tradional sense and as protection of personal data, has now achieved a solid legal acknowledge: first of all, we should consider articles 7 and 8 of the EU Charter of rights and case law of both the Court of Justice and the Court of Strasbourg. Secondly, we need to mention EC (noe EU) Law, beginning with the Directive 95/46/ EC, folowed, at the national level, by law n. 675/1996 and then by the so-called Privacy Code (Legislative Decree no. 196/2003). Finally, the need for a more coherent framework at European level has led to the adoption of the new Regulation on data protection (EU Regulation 2016/679), which, by repealing Directive 95/46, produces a fundamental work of standardization of the national laws on the subject. Once descrived the theoretical framework, there are two theoretical and practical focus on the legal framework (Legislative Decree. N. 196/2003 and EU Regulation 2016/679) and the activities of Data Protection Authority. Such focus are the necessary link between the theoretical and the practical part, represented by a legal service to the administrative staff of the University. 20110074 - ATTIVITA': International Humanitarian Law Legal Clinic (objectives) Focus: International Humanitarian Law Legal Clinic The “International Humanitarian Law Legal Clinic” (IHL Legal Clinic) has been established in order to permit students involved in the IHL course of the Law Department to cooperate on a pro bono basis on research projects of relevant stakeholders operating in this area and acquire significant skills beneficial for their competences and future activities. The IHL Legal Clinic is inspired by a ‘learning by doing’ approach permitting students to develop their competences in legal research, drafting, writing and organization of activities on the basis of knowledge acquired in their academic curricula, in particular through the international humanitarian law course, in order to facilitate the transfer of theoretical analysis into a practical perspective. 20110046 - Diritto Penale Europeo (objectives) The course "European Criminal Law" aims to examine the progressive influence on the national criminal law by European law, that include the EU law and the ECHR system. Until a few decades ago the combination of "European law" and "criminal law" appeared almost an oxymoron. The system of sources of law is conversely today more complex and labyrinthine and, at least in some respects, it is gradually changing the face of criminal law, that seemed like the more solid articulation of national sovereignty. The lessons will be developed following the main theme of the principle of legality in criminal law, in its articulations of the legislature's exclusive power to create crimes, the principle of determinacy and the principle of non retroactivity of criminal law (supplemented by that of the retroactivity of more favorable law): the objective it is to examine the metafomorphosis of the criminal legality, especially as a result of European jurisprudence. The course will also try to focus on the significant changing of the Italian system of sanctions as a result of the europeanisation of criminal law, on the side of the "double track" between criminal penalties and security measures and on the side of the compresence of criminal and administrative sanctions. INTERNET OF THINGS, DATA DRIVEN INNOVATION: SOCIAL, ECONOMIC AND LEGAL ASPECTS (objectives) The aim of the seminar is to render students aware of the social, economic and legal aspects of one of the most innovative areas of information and communication technologies (ICT). Data have been qualified as the “new oil” of contemporary societies. Although the expression may be misleading, surely the next years will be marked by an enormous development of technologies able to collect, store and process amounts of data which are, for the moment, enumerable in billions of billions. This will be due not only to the increasing use by individuals of ICTs which will record very activity, but also by the dissemination of so called “Internet of the things”, i.e. objects, from extremely complex as an automobile, to extremely simple, as a food product, that will provide in real time information on their location, their environment, their use. This can be an extraordinary opportunity for development – commonly defied as “Data-driven innovation” - but it presents also challenges that lawyers will have to face and try to resolve, such as the philosophical issues of self-determination and of free-will; in what legal category does data fall; the application of data protection laws; the contracts concerning the collection and trade of data; intellectual property rights over data and competition concerns. 20101107 - CIVIL PROCEDURE I (objectives) Civil procedure attends to dynamic field of judicial experience; the one is affirming the existence of rights, the other is their effective being and peaceful practice. Whether a right is denied or its practice is forbidden, we need effective redress devices. Civil procedure attends to relationships between claimant and defendant. Before studying how proceedings are regulated, however, we need to describe the aim which they can pursue, that is protection forms, which overlap to different kinds of manageable action. We need to specify prerequisities of Courts before which the proceedings is brought, as well as qualities of parties involved in the proceedings, and devices that each of them can use. These general topics concern the first part of the course.
