In the first part of the seminar we’ll discuss basic elements of economic analysis of public law, known as public choice theory. In our first meeting we’ll identify two distinct public choice theories—“a public interest” approach (aka Madisonianism or “republicanism”) vs. “public of interests” view (aka “pluralism”). Under the former, decision-makers should base their decisions on “public reason” (in the Rawlsian sense) rather than on self-interest. The aim of public law is to ensure that decision-making is based on impartial considerations. In contrast, the competing theory reflects a welfarist approach, under which the desired social decisions are those that maximize some social welfare function. In general, it endorses a decentralized approach, in which the social decision is achieved by aggregating the relevant persons’ interests and preferences. Accordingly, the aim of public law under this view is to ensure that decisions accurately aggregate the various interests of those affected. We will discuss the central normative and behavioral aspects of each of these theories. In subsequent meetings we will explore some of their implementations in public choice theory and in public law doctrines, regarding four central types of decision-makers: the public, representatives, the Executive Branch and the judiciary.

JURIDICAL COMPARISON AND STANDARDISATION OF LAW

The course aims to provide students with basic knowledge on juridical comparation in the frame of the integration process of the European Union and in the international legal context. The course examines the legal comparison primarily intended as a way of studying and understanding the law, but also as a socio-cultural and technical-professional phenomenon, linked not only to a specific territoritorial connection, but also to a global dimension of space between different and interdependent worlds and cultures. In particular, during the course, some relevant methodological and substantial issues on the comparative study of law are examined, focusing on specific issues such as: the modern origins of comparative law and the notion of open legal system, the concept of law and the various “types” of law, the legal interpretation, the historical forms of property in the European juridical culture, as well as the legal experience of the traditional Chinese world. In this frame, the course intends to deepen the methodological and theoretical issues of the uniformation of the law, with specific reference to the formation of European Union law, the European citizenship as its base of legitimacy and the fundamental rights as elements of integration of the European identity. The course examines the development of models and techniques of the uniform law in the frame of the globalization phenomenon, focusing on the European contractual law, the circulation of the goods and the intellectual property rights.

The organization of the Italian government system has undergone a profound change characterized by progressive decentralization. Since the creation of the Regions in 1970, up until the reform of Title V of the Constitution in 2001, the central government has transferred an increasing number of functions to local governments and has devolved powers and responsibilities to the Regions. Hence the importance of the Public Finance in a Decentralized Government for those seeking employment both in public and in private sectors that have to do with the public administration and for those who intend to deal with health sector In fact, as local and regional authorities play an key role in the Italian healthcare, part of the course will analyze the Healthcare sector. The contradictions that emerge between the attribution to the Regions of healthcare delivery and the imposition of rigid organizational models as well as the maintenance at central level of an organization role, will be the subject of in-depth analysis in order to understand the relationship between State, Regions and Local Authorities in the organization, management and provision of health services.

The first part of the course will consist of lectures, during which also photographs and footage will be employed. The second part of the course will be structured as a specialized seminar. After a series of lectures during which the instructor will introduce the main topics of the seminar, attending students will be required to do one presentation in class about a book, which will be chosen from a selection provided by the instructor at the beginning of the course. Class discussion will follow each presentation. At the end of the course, attending students will be required to write a 4000 word paper, analyzing the book chosen in the light of the analyses and discussions from the seminar.
Only for attending students, assessment related to the first part of the course may take the form of a mid-term written exam, to be taken during the course (esonero). With regard to the seminar, the grade for this part of the course (which will average with the grade obtained for the first part) will be attributed on the basis of the student’s performance in the following activities: PRESENTATION: 30%; FINAL PAPER: 50%; PARTICIPATION TO CLASS DISCUSSIONS: 20%.

The aim of the course is the study of Spanish Language and Culture through a communicative and social-cultural competence. We will get into the study of the Hispanic environment. Module I examines in depth the study of phraseology for specific purposes (political language) from a cultural and communicative point of view. Module II refers to cultural aspects; the course will focus on the presence of Hispanic culture in the Mediterranean and Caribbean areas.

The course (8 CFU) is divided into two modules: 1) Sectorial languages 2) Analysis of political discourse Module I Sectoral Languages: Topics will be covered with lectures and seminars. Attendant students are therefore required to follow both lectures and seminars. Attending students must agree on the subject of the final paper with the teacher.
Module I: The political language: the topics will be dealt with frontally and it is planned to carry out a paper to be agreed with the teacher.
Module II prepare a paper in Spanish by analysing 4 political speeches (at least two in Italian)

The organization of the Italian government system has undergone a profound change characterized by progressive decentralization. Since the creation of the Regions in 1970, up until the reform of Title V of the Constitution in 2001, the central government has transferred an increasing number of functions to local governments and has devolved powers and responsibilities to the Regions. Hence the importance of the Public Finance in a Decentralized Government for those seeking employment both in public and in private sectors that have to do with the public administration and for those who intend to deal with health sector In fact, as local and regional authorities play an key role in the Italian healthcare, part of the course will analyze the Healthcare sector. The contradictions that emerge between the attribution to the Regions of healthcare delivery and the imposition of rigid organizational models as well as the maintenance at central level of an organization role, will be the subject of in-depth analysis in order to understand the relationship between State, Regions and Local Authorities in the organization, management and provision of health services.

Articolazione del corso Il corso è articolato in tre fasi, la prima economica, la seconda istituzionale e la terza tematica. Nella prima fase si studiano gli effetti economici del federalismo fiscale, le forme, i casi in cui si hanno vantaggi in termini di controllo dei rappresentanti politici, le capacità di ridistribuire reddito rispetto ad un sistema centralizzato, i rischi che può comportare in un sistema economico caratterizzato da squilibri regionali. Nella seconda fase si studia il processo di riforma dell’ordinamento fiscale italiano fino alle più recenti riforme. Nella terza fase, si studia il settore Sanitario, oggetto, più di altri, di profonde riforme normative in una prospettiva federale. L' avvio del federalismo fiscale e il riordino del Sistema Sanitario Nazionale (SSN) costituiscono due innovazioni potenzialmente in grado di modifica re in modo sostanziale l’assetto della finanza regionale. La sanità, infatti, può essere considerata a pieno titolo il settore che ha operato da banco di prova del federalismo fiscale, in quanto essa ha attuato cambiamenti che vanno nella direzione del trasferimento delle responsabilità a livelli di governo sub-centrali e della progressiva espansione del ruolo delle regioni.
